General Terms and Conditions (GTC)

1. Scope
These General Terms and Conditions apply to all orders and deliveries of handmade cakes, cupcakes, and baked goods produced by Torten Art (owner: Emina Kadiric, Orpund, Switzerland).Any order implies acceptance of these General Terms and Conditions.2. Offer and Order
Each cake is handmade and custom-crafted according to the customer's wishes, making each one a unique piece.Orders must be placed in advance (ideally 1 to 2 weeks before the desired date) via WhatsApp, email, or phone.A binding contract is concluded as soon as the details (design, size, flavor, date) have been confirmed by both sides.3. Prices and Terms of Payment
All prices are in Swiss Francs (CHF). Since each cake is unique, prices are calculated based on size, workload, decoration (e.g., 3D figures, edible prints), and fillings.Payment is made according to the agreement upon pickup (in cash or via TWINT) or in advance by bank transfer / TWINT.4. Pickup, Storage, and Transport
Pickup: The ordered products can be picked up on the agreed date in Orpund (BE). Upon handover, the risk of damage is transferred to the customer.Transport: As these are fragile food items, it is strongly recommended to transport the cake with the utmost care (someone holding the cake during transport, placing on a flat surface in the vehicle, for example in the trunk or on the floor).Storage: Cakes and cupcakes must be kept cool in the refrigerator until consumption.Delivery: Deliveries are only possible in exceptional cases, by prior agreement, and for an additional fee.5. Modification and Cancellation
As these are perishable goods and custom-made items, returns or exchanges are not accepted once the products have been handed over. Any complaints or issues regarding the design or quality must be raised directly at the time of pickup.Modifications requested after work has begun may be accommodated if feasible, provided they do not significantly alter the agreed design or core concept. Any such changes may incur additional charges for extra work, new materials, or the adaptation of components already produced.Cancellations are possible up to the cancellation deadline specified in the corresponding order confirmation. After this deadline, 50% of the total amount will be charged as compensation.For cancellations made less than 48 hours prior to the agreed pickup time, Torten Art reserves the right to invoice the full order amount should production be substantially advanced or completed.6. Liability, Allergies, and Declarations
Our products are crafted with the utmost care and in compliance with applicable food regulations. Our production areas have been inspected and approved by 'Bern Kantonales Lebensmittlelinspektorat' in compliance with cantonal hygene and operating requirements.Each customer receives a corresponding declaration with their cake, containing information on present allergens (e.g., nuts, gluten, lactose, eggs) as well as specific dietary requirements (e.g., alcohol-free, halal, kosher, vegetarian, vegan).It is the customer's responsibility to fully inform the provider of all allergies, intolerances, or specific dietary requirements (such as halal, alcohol-free, kosher, vegan, etc.) upon ordering.Likewise, it is the customer's responsibility to inform their guests of the composition and allergens contained in the cakes.7. Image Rights and Social Media
We reserve the right to publish photos of the cakes and creations we make for documentation and promotional purposes (e.g., on our website, Facebook, Instagram, or Pinterest).If you explicitly do not wish this, please kindly inform us when placing your order.8. Applicable Law and Jurisdiction
Swiss law applies. The place of jurisdiction is set at the company's registered office (Orpund, BE).
